A Petition under Section 528 BNSS has been filed on behalf of the petitioner for quashing of FIR No.300/2021 under Section 323/341/354/354B/506/509/195A/34 IPC registered at Police Station Paharganj.

Briefly stated, the complainant/respondent No.2 had given a complaint to the Police of Police Station Paharganj and got an FIR registered under Sections 323/341/354/354B/506/509/195A/34 IPC against the petitioners.

It is submitted that both the petitioners and respondent No. 2 have already sorted out their all differences with the intervention of their

respective persons of the vicinity and they have arrived at a Settlement vide Settlement Deed dated 19.07.2024. It is submitted that they Settlement has been arrived at between them without any force, pressure and coercion and that they undertake to abide by the terms of the Settlement Deed dated 19.07.2024. It is submitted that they have left no grudge or grievance against each other in any manner whatsoever. Therefore, the Petition be quashed.

The complainant/respondent No.2 is present in the Court and submits that the dispute between them was on account of Jhuggi and that now the matter stands settled with all the petitioners. She has no objection if the FIR is quashed against the petitioners on account of the settlement already arrived at between the parties.

The parties are present before this Court in-person today, and have been identified by their counsel and Investigating Officer concerned. 6. In view of the submissions made, the Petition is allowed. Accordingly, the FIR bearing No. 300/2021 registered at Police Station Paharganj, for offences punishable under Sections 323/341/354/354B/506/509/195A/34 IPC with all the subsequent proceedings and the charge sheet is hereby quashed qua all the petitioners.
