These petitions have been filed seeking quashing of cross FIRs, that is, FIR No. 0488/2017 under Sections 451/324 of the Indian Penal Code, 1860 (in short, ‘IPC’); and FIR No. 0489/2017 under Sections 325/341/34 IPC, registered at Police Station: Jafrabad, Delhi, against each other by the parties, who are family members.

By way of a Memorandum of Understanding/Compromise Deed dated 01.11.23, they have now settled their disputes and do not wish to pursue these FIRs/complaints against each other.

As the petitioners are family members and they wish to bring peace amongst themselves, keeping in view the principles laid down by the Supreme Court in Gian Singh v. State of Punjab (2012) 10 SCC 303 and State of Haryana & Ors. v. Bhajan Lal & Ors. 1992 Supp (1) SCC 335, the abovementioned FIRs and all the proceedings emanating therefrom are hereby quashed.

However, as the petitioners have abused the criminal process for settling their inter se disputes, they are burdened with costs of Rs.7,500/-, each which they shall deposit with the Delhi State Legal Services Authority within a period of two weeks from today. The amount so deposited shall be utilised by the Delhi State Legal Services Authority for providing support to the Acid Attack Victims requiring such assistance.

The petitioners, in both the petitions, shall file the proof of deposit of the costs with the Registry of this Court and shall also supply a copy thereof to the IO, within the above period.

The petitions are disposed of in the above terms.
