1. Petition under Section 482 of the Code of Criminal Procedure, 1973 (‘Cr.P.C.’) has been preferred on behalf of the petitioner for quashing of FIR No. 482/2018 under Section 363 IPC registered at P.S.: Nihal Vihar and proceedings emanating therefrom. Chargesheet has been filed under Sections 363/366A/376 IPC.

2. Learned counsel for the petitioner submits that respondent no. 3 had voluntarily left the parental house and was a major at the time of registration of FIR.

However, learned APP for the State, on instructions of the Investigating Officer, submits that respondent no. 3 / victim was merely aged about 13 ½ years at the relevant time and the same is supported by the school record. She further submits that being a minor, respondent no. 3 could not legally marry the petitioner.

5. Considering the totality of facts and circumstances, an endeavour shall be made by the learned Trial Court to conclude the trial preferably within a period of four months from the next date of hearing fixed before the learned Trial Court.

Petition is accordingly disposed of. Pending applications, if any, also stand disposed of.
