Mr. B.S. Bagga, learned counsel appearing for the petitioner submits that since the action has already been taken against the unauthorised construction existing in the properties in question by the Municipal Corporation of Delhi (“MCD”), he has instructions to withdraw the present petition, with liberty to revive the petition, in case in future, any unauthorised construction is carried out in the subject property.

Learned counsel appearing for respondent nos. 6 and 7 enters appearance and submits that at the time of disposal of the writ petition, i.e.,

W.P.(C) 15973/2023 by order dated 12^th December, 2023, the said respondents had not given any undertaking before the writ Court. 3. He further submits that respondent nos. 6 and 7 reserve their right to approach the Appellate Tribunal; Municipal Corporation of Delhi (“ATMCD”) in terms of the statutory remedy available to them.

Accordingly, the present petition is disposed of, as having been satisfied, with liberty to the petitioner to revive the present contempt petition, in case any further unauthorised construction is carried out in the properties in question.
