The present petition has been filed alleging willful disobedience of the th judgment dated 19 October, 2023 passed by the Division Bench in W.P. (C) No. 13616/2023 .

By way of the aforesaid order, the following directions had been issued:-

7. In view of the above, we direct the respondents to schedule a skill test and to permit the petitioner to participate in the documentations and the skill test.

8. In case the petitioner is successful in the documentation and the skill test, further steps be taken by the respondent in regard to the selection process qua the petitioner.

9. It is directed that the entire process with regard to conduct of the skill test and document verification and further steps be taken by the respondent prior to the declaration of the final result for the said post.

It is the contention of the petitioner that pursuant to the orders of the Division Bench, the petitioner was called for skill test and documentation. However, the petitioner was not informed about his result. It is submitted that the respondents have now issued fresh result, without any communication to the petitioner, which is in total violation of the aforesaid judgment.

Per contra, learned counsel appearing for the respondent submits that the petitioner was called for the skill test and documentation and verification of documentation. However, the petitioner could not qualify in the skill test. Thus, it is submitted that the petitioner was not called for further proceedings.

Considering the aforesaid submissions, this Court is of the view that no contempt has been committed by the respondent. The judgment passed by the Division Bench was to the effect that the petitioner shall be called for the skill test and the petitioner was also permitted to participate for his verification of documents.

Both the aforesaid opportunities were granted to the petitioner.

Unfortunately, the petitioner was unable to clear the skill test. Thus, there was no question of taking any further steps by the respondent in regard to selection process qua the petitioner.
