The petitioner is seeking initiation of contempt proceedings against the officials of the respondents for alleged wilful disobedience of directions of this Court dated 02.07.2024 passed in WP(C) No.4227/2016.

Learned counsels for respondent No.1/DDA as well as DUSIB are present on advance notice.

The grievance of the petitioner is that despite there being a direction to ensure that on the demolition action being carried out, the petitioner and other similarly placed dwellers would be accommodated in the shelters homes maintained by DUSIB, albeit for a limited period, so as to enable them to make alternate arrangements for themselves and such accommodation was not made. It is submitted that he along with family, has been thrown out on the road.

Learned counsel appearing for respondent No.1/DDA has submitted that the demolition order has been carried out pursuant to directions of this Court and appropriate notices in Hindi were displayed at the site thereby enabling the dwellers, who have been displaced from the site in question, to seek appropriate accommodation at the shelter home situated at Geeta Colony as well as in Dwarka, Sector-6, Phase-1. Some photographs are also placed on the record showing the display of notices at the site.

Learned counsel for the petitioner has disputed that any notice was pasted on the site and it is urged that no official from the concerned departments ever approached the petitioner and his family members so as to guide them to the appropriate shelter homes. 6. Be that as it may, after hearing learned counsels for the parties, since the officials of DDA are present, the contact numbers have been shared with learned counsel for the petitioner and it is provided that the petitioner along with his family be accommodated at the shelter homes run by DUSIB at Sarai Kale Khan, for a period of atleast 30 days.

In the meanwhile, the petitioner shall make his alternative arrangement for their accommodation as suited to him and his family members.

While disposing of this petition, the learned counsel for the petitioner has also urged that those dwellers who have been uprooted and displaced along with the petitioner herein may also be provided temporary accommodation in the shelters in terms of the previous directions of this Court. Needless to state, those similarly situated shall also be accommodated as per the established parameters.

The petition is disposed of accordingly.
