The record shows that the counsel for the respondent had appeared on 10.10.2023 and sought time to apprise this Court as regards the further participation of his client in the present case. However he never appeared thereafter.
Accordingly be listed before the Hon'ble Court on 15.04.2024, since the petitioner could not be served despite diligent efforts.
It is noted for the record that the counter-reply has already been filed by the respondent no. 1 before the Intellectual Property Appellate Board.”
