This is a petition under Section 27 of the Arbitration and Conciliation Act, 1996 for issuance of summons to the witnesses who are required to appear before the ld. Sole Arbitrator- Ms. R. Kiran Nath, Retired ADJ in the Arb. Pet No. 678 of 2020 on 29th and 30th January, 2024.

Accordingly, let summons be issued to the following three witnesses:

The said summons shall be valid for any subsequent dates before the Arbitral Tribunal as well. In view of the urgency of the matter, ld. Counsel for the Petitioner shall follow upon with the Registry for issuance of summons.

Insofar as the Drug Inspector from CDSCO, Mumbai is concerned i.e., Mr. Mukul Singh, ld. Counsel for the Respondent submits that the Drug Inspector would appear before the Arbitral Tribunal on the date fixed.

For the remaining two witnesses, the diet money as per the prescribed Rules shall also be deposited by the Petitioner before the ld. Arbitrator who may release the same upon their appearance.

The petition is, accordingly, disposed of. All pending applications are disposed of.
