The present petition has been filed under Section 439 CrPC seeking extension of interim bail granted to the petitioner which was granted by the Court of learned ASJ-03, South-East, Saket Courts, Delhi, vide order dated 12.12.2023 and was extended vide order dated 29.01.2024.

The learned counsel for the petitioner invites the attention of the Court to the certificate issued by the Ektaa Hospital, Gurugram, to contend that the wife of the petitioner has been operated for Sub-mucosal abscess on 23.02.2024 and she has been advised post operative management.

He submits that the petitioner is the only male member available in the family as the petitioner’s father is also behind the bars and there is a two

The learned counsel, on instructions, submits that no further extension shall be sought in case the petitioner is granted extension for a period of four weeks. The Statement is taken on record.

Issue notice. The learned APP for the State accepts notice.

Since it is an application seeking extension of interim bail and factum of ailment of petitioner’s wife already stood verified, the bail application is taken up for disposal.

Having regard to the submissions made by the learned counsel for the petitioner and the certificate placed on record, the interim bail granted to the petitioner is extended further for a period of four weeks from today as per same terms and conditions as mentioned in order dated 12.12.2023.

Upon expiry of period of four weeks as stated above, the petitioner shall surrender before the Jail Superintendent.

The petition stands disposed of.

Copy of the order be forwarded to the concerned Jail Superintendent for necessary compliance and information.
