the applicant had agreed to sell the subject property to the complainant. On a prima facie consideration of the facts and circumstances of the present case, this Court is of the opinion that the applicant was involved in the conspiracy to cheat the complainant inasmuch he received the amount in his account and further transferred the same. In addition, the pendency of another FIR regarding the very same property against the applicant is also indicative of the applicant’s involvement.
