By way of present application filed under Section 438 Cr.P.C, the petitioner/applicant seeks anticipatory bail in FIR No.112/2019 registered under Sections 418/467/468/471IPC at P.S. Mansarovar Park.

Learned counsel for the applicant submits that a Collaboration Agreement was entered into between the applicant and the complainant’s father, who during his lifetime never denied having his signatures on the said sanction plan. He submits that the applicant has constructed as per the Collaboration Agreement and that the present FIR came to be registered six years after the death of the father of the complainant. applicant has been granted interim protection and he has joined investigation during which he has also given his specimen signatures.

At this stage, learned APP for State submits that contrary to the terms of Collaboration Agreement, the applicant has occupied six flats which otherwise had to go to the share of the complainant’s father. 4. Learned counsel for the applicant submits that the applicant has already vacated one of the flats. Further, another one is in the process of being vacated and will be completely vacated by tomorrow. He undertakes that the other four flats which are presently occupied by the applicant, will be vacated within a period of four weeks from today. This undertaking of applicant is accepted and taken on record.

At this stage, learned APP submits that I.O. is in the process of sending the documents to FSL.

On a prima facie view and keeping in view the aforesaid facts and circumstances including the fact that the applicant is on interim protection for a long time and that the complainant’s father on his lifetime never alleged forgery of his signatures, it is directed that in the event of arrest, the applicant be released on bail subject to him furnishing a personal bond in the sum of ₹ 25,000/- with one surety of like amount to the satisfaction of the Arresting Officer/Investigating Officer/SHO of the concerned Police Station and also subject to the following further conditions:-

(i) At the time of furnishing bail bond, the applicant shall provide the mobile number, which she undertakes to keep operational at all times during the pendency of the trial.

(ii) The applicant shall join the investigation as and when asked.

(iii) The applicant shall inform the concerned Investigating Officer about her current residential address.

(iv) In case of change of residential addresses/contact details, the applicant shall promptly inform the same to the concerned Investigating Officer/SHO.

(v) The applicant shall not directly or indirectly try to get in touch with the complainant or any other prosecution witnesses or tamper with the evidence.

(vi) The applicant shall regularly appear before the trial Court.
