These applications have been filed by the Petitioners for grant of bail in the event of arrest in FIR No. 36909 dated 28.11.2023 registered at Police Station e-Police Station (Rajouri Garden) for an offence under Section 379 IPC.

Material on record discloses that the instant FIR has been filed at the instance of one Jasbir Kaur, who is the mother of the Petitioners herein. The case is one of theft of a vehicle bearing registration No. DL 12 CV 3909. According to the complaint, the vehicle was stolen from the address of the Complainant, i.e., H. No. 14/90, Ground Floor, Subhash Nagar, New Delhi110027 on 24.11.2023.

The allegation of the Complainant is that after the death of her husband, her sons are pressurizing her and torturing her for transfer of the ownership of the property and they have forcefully taken her jewellery. This Court is not concerned with the other allegations since the FIR is limited to the case of stolen vehicle.

Status Report has been handed over by the learned APP in Court today. The same is taken on record. Learned APP is also requested to place the same on record.

A perusal of the Status Report indicates that after the registration of the FIR, investigation was carried out and during the course of the investigation, statements of the witnesses were recorded on the basis of the CCTV footages that were collected and it was found that the car was towed away with the help of a crane.

During investigation, it was revealed that one person accompanied the person operating the crane and upon his instructions, the said car has been towed away to Malviya Nagar. The photographs of the three sons of the Complainant were shown to the crane staff and he has identified Asmeet Singh, i.e., Petitioner in BAIL APPLN. 1155/2024.

It is the case of the Police that the Petitioners are not cooperating with the investigation. The facts of the case reveal that it is primarily a dispute between the mother on the one side and the children, i.e., Petitioners herein, on the other side.

This Court also made an effort was made to amicably settle the disputes between the parties and the parties were referred to Delhi High Court Mediation & Conciliation Centre but unfortunately the mediation has

failed.

The dispute is between the mother and sons. This Court is of the opinion that custodial interrogation of the Petitioners is not required. The Petitioners are directed to cooperate with the investigation and appear before the IO as and when required.

In view of the above, the Petitioners shall be granted bail in the event of arrest in FIR No. 36909 dated 28.11.2023 registered at Police Station e- Police Station (Rajouri Garden) for an offence under Section 379 IPC on the Petitioners furnishing a personal bond in the sum of Rs.50,000/- with two sureties in the like amount to the satisfaction of the Investigating Officer/SHO.

The Petitioners are also directed to cooperate with the investigation.

Liberty is granted to the Police to approach this Court for cancellation of bail in case the Petitioners do not cooperate with the investigation.

With these observations, the petitions are disposed of along with pending application(s), if any.
