The present application is filed seeking regular bail in FIR No. 15/2024 dated 02.04.2024, registered at Police Station Cyber Police Station West, for offence under Section 420 of the Indian Penal Code, 1860 (‘ IPC ’). Chargesheet in the present case has been filed under Sections 420/467/468/471/34 of the IPC.

The FIR was registered on a complaint given by Mr. Karan Saluja alleging that a sum of ₹11,00,000 had been cheated out of his bank account. It is alleged that an amount of ₹1,00,000/- was transferred to the applicant’s bank account by the complainant. During the investigations, it was revealed that the applicant had opened a bank account with IDFC Bank using fake IDs in the name of Rajiv Gupta having his photograph on fake IDs. It was further revealed that at his instance, two fake IDs, that are, Aadhar Card and Pan Card in the name of Rajiv Gupta have also been

recovered. It is also stated that 7 other fake identity cards in different names having his photograph have also been recovered from the house of the applicant.

The learned counsel for the applicant submits that the applicant and the complainant have settled their disputes.

The said fact is confirmed by the Investigating Officer. The Memorandum of Understanding dated 02.09.2024 has also been placed on record wherein the complainant had agreed that he will support the petition seeking quashing of the present FIR. The duly sworn affidavit of the complainant has also been placed on record affirming that the parties have settled their disputes.

In view of the above, in the opinion of this Court, the applicant has made out a case for bail and is directed to be released on bail on furnishing a personal bond for a sum of ₹25,000/- with one surety of the like amount, subject to the satisfaction of the learned Trial Court, on the following conditions:

a. The applicant shall cooperate in any further investigation as and when directed by the concerned IO;

b. The applicant shall under no circumstance leave the country without the permission of the learned Trial Court;

c. The applicant shall appear before the learned Trial Court as and when directed;

¶19

d. The applicant shall provide the address where he would be residing after his release and shall not change the address without informing the concerned IO/ SHO;

e. The applicant shall, upon his release, give his mobile number to the concerned IO/SHO and shall keep his mobile phone switched on at all times.

In the event of there being any FIR/DD entry / complaint lodged against the applicant, it would be open to the State to seek redressal by filing an application seeking cancellation of bail.

It is clarified that any observations made in the present order are for the purpose of deciding the present bail application and should not influence the outcome of the trial and also not be taken as an expression of opinion on the merits of the case.

The bail application is allowed in the aforementioned terms.

The date already fixed, that is, on 30.09.2024, stands cancelled.
