ground that though the present petitioner was arrested on the disclosure statement of her husband, Mr. Siddharth Gautam. However during the investigation of the case, mobile phone of Mr. Siddharth Gautam bearing no. 8448706696 and mobile phone of the present petitioner bearing no. 8130995953 was seized. Learned APP submits that taking of the mobile phone of the accused, it was revealed that the main source of the recovered drugs, Shivam @ Sukhi, and the present petitioner was in constant touch through WhatsApp chat, Instagram chat, WhatsApp audio calls and regular video calls. Learned APP submits that some incriminating Instagram chats on the petitioner’s mobile phone with the main source, Shivam @ Sukhi i.e. “ Saman abhi pack mat karna or kr diya hai to khol lo phle weight hoga kitna gm hai fir pack hoga ”. Learned APP submits that even the photographs of the weighing machine were also found in the petitioner’s mobile phone along with a video of making pudia (pouches) of the smack / heroin was also found in the mobile phone. Learned APP submits that the mobile phone has been sent to FSL and the FSL report is still awaited.
