Application under Section 439 of the Code of Criminal Procedure, 1973 (‘Cr.P.C.’) has been preferred on behalf of the petitioner for grant of regular bail in FIR No. 0450/2019 under Sections 387/506/120B/34 IPC registered at P.S.: Kishan Garh.

In brief, as per the case of prosecution, complainant alleged that petitioner and his sons Bhanu Pratap and Keshav Singh along with nephew Sandeep @ Bholu extended threats to cause death and grievous hurt for extortion. Also the renovation/repair work carried out in the premises of complainant, was forcibly stopped by the accused on 29.11.2019.

Learned counsel for petitioner submits that five out of six accused have already been admitted to bail and chargesheet has been filed. He further contends that allegations against the petitioner relate to extending threat of extortion telephonically, but the phones alleged to have been used in the incident were not forwarded to FSL.

On the other hand, application is opposed by learned APP for State and she submits that petitioner is also involved in several other cases.

Petitioner is in custody since November 2023 and is no more required for purpose of investigation. The case of petitioner is stated to be at parity with co-accused who have been admitted on bail. Considering the totality of facts and circumstances, petitioner is admitted to bail on furnishing a personal bond in the sum of Rs. 1,00,000/- (Rupees One Lakh only) with one surety in the like amount to the satisfaction of the learned trial court and subject to the following conditions :

(i) Petitioner shall provide his mobile number to the Investigating Officer (IO) / SHO concerned.

(ii) Petitioner shall not threaten or influence the witnesses in any manner.

¶20

(iii) In case the petitioner tries to threaten or influence the witnesses in any manner, the order of bail shall stand withdrawn.

A copy of this order be forwarded to the Superintendent Jail and concerned Trial Court for information and compliance.
