The petitioner, who superannuated as an Inspector in the CRPF, has approached this Court under Article 226 of the Constitution of India seeking the following reliefs:

“ (a) To call the service book record of the petitioner namely Anand Pratap Singh Force No. 841110501 along with details of pay fixation of the petitioner from his joining to till date and also the service record and pay fixation details from joining to till date of juniors and similarly placed personnel such as Gopi Lal whose Force No .841110885; Manender Kumar Tiwari· whose Force No 841110482 so that basic pay anomaly may kindly be verified;

(b) To direct the respondents to fix/correct the basic pay scale of the Petitioner @ Rs.58,600/- p.m.;

(c) To direct the respondents to give the arrears to the petitioner after re-fixation of his basic pay scale from the

date since when the basic pay has been fixed wrongly by the respondents along with subsequent benefits arising there from;

(d) Any other relief/order/direction as the Hon’ble Court may deem fit and proper.”

Learned counsel for the petitioner submits that despite various representations made by the petitioner for correction of the anomalies in his pay scale, the respondents have not responded to the same compelling him to approach this Court.

Issue notice. Learned counsel for the respondents accepts notice and submits that the respondents are willing to consider the petitioner’s claim within the time as may be granted by this Court.

Taking into account that a copy of the representation, which the petitioner claims to have submitted with the respondents, is not on record, we grant two weeks’ time to the petitioner to submit a fresh representation through his counsel to the respondents. The said representation will then be decided by the respondents by passing a reasoned and speaking order within six weeks from the date of its receipt. Needless to state, in case the petitioner is aggrieved by any order passed by the respondents, it will be open for him to seek legal recourse, as permissible in law.
