Petitioners have approached this Court for a direction to the Respondent to change the category from General Ward entitlement to Semi Private Ward entitlement on the CGHS Cards issued to them in view of the Office Memorandum dated 09.01.2017 bearing No. S.11011/11/2016CGHS(P)/EHS.

It is stated that the Petitioner joined the services at the Office of the Defense Accounts Departments on 08.11.1963 and he retired from the services on 28.02.2002 from the post of Senior Auditor. The last emolument drawn by the Petitioner, as reflected in the PPO details, is Rs.50,500/-. The

Petitioner places reliance on the Office Memorandum dated 28.10.2022 under which an officer drawing basic pay between Rs.36,501/- to Rs.50,500/- is entitled to Semi-Private ward. It is stated that the Petitioner is likely to undergo a surgery in the near future and, therefore, the Petitioner has given a representation to the Respondent for change of entitlement from General Ward to Semi-Private Ward but the same has not yet been considered.

Respondents are directed to consider the representation of the Petitioner and take a decision within three weeks from today to ascertain as to whether the Petitioner is entitled to change in the entitlement from General Ward to Semi-Private Ward or not.

The Writ Petition is disposed of. Pending applications, if any, also stand disposed of.

Liberty is granted to the Petitioner to approach this Court in case the representation of the Petitioner is not decided within three weeks from today.

It is made clear that this Court has not made any observations on the merits of the case.
