Sls College of Pharmacy v. Pharmacy Council of India
Case brief
What is this about?
The Supreme Court held that approval under Section 12(1) of the Pharmacy Act, 1948, granted to an educational institution for a course of study (B. Pharm/D. Pharm), is for the entire duration of the course, not for individual academic years. The Pharmacy Council of India lacks authority to demand yearly renewal of such approvals or to charge annual Renewable Education Regulatory Council (PERC) fees. The requirement for such renewal is ultra vires the Act, except for M. Pharm courses which require renewal after five years. The impugned circular was quashed.
What did the court decide?
Paras 10(ii), (iii) and (iv) of the impugned Circular dated 14 December 2023 quashed. Declared approval granted under Section 12(1) applies to the entire course of study and not to any one year. Declared that PCI cannot demand yearly renewal or PERC fees on an annual basis. Amount deposited by petitioners as per previous orders to be returned within four weeks.
