to fully participate in the limited tender process for the Indian Air Force over the forthcoming three years. The imposition of these conditions, according to the Petitioner, lacks transparency and rationality, particularly when the products had already passed the requisite testing and compliance procedures. He further submits that the rig test was never a part of the approved Qualifications Test Schedule and if the same was mandatory requirement, it ought to have been made part of the prescribed Qualifications Test Schedule. Lastly, he argues that the Petitioner is being singled out, as no rig test has been conducted for any other third party.”
