Present writ petition has been filed by the petitioner seeking directions to the respondents to constitute a Monitoring Committee for regulating the reconstruction of the shops in Bhagirath Palace Market and to further direct the respondents to demolish any unauthorized constructions erected within the Bhagirath Palace Market to avoid any fire incident in the future.

Learned counsel for the MCD states that the shopkeepers have already filed writ petitions (W.P.(C) Nos. 13644/2023, 14346/2023 and 16396/2023) seeking permission to reconstruct and for sanction of their building plans. He states that the appropriate course of action of the petitoner would be to file intervention applications in the writ petitions already filed by shopkeepers.

This Court is of the view that the suggestion made by the learned counsel for MCD is fair and reasonable.

Accordingly, the present writ petition and applications are disposed of with libery to the petitioner to file intervention applications in W.P.(C) Nos. 13644/2023, 14346/2023 and 16396/2023 and seek appropriate relief in those matters.

This Court clarifies that it has not commented on the merits of the matter. The rights and contentions of the parties are left open.
