This application under Order XXIII Rule 1(3) read with Section 151 CPC has been filed on behalf of the applicant/petitioner for withdrawal of the present civil revision petition.

It is submitted by the learned counsel for the petitioner that for the reasons assigned in the application, the petitioner does not wish to pursue the matter any further. It is requested that the petition may be allowed to be dismissed as withdrawn simpliciter .

Learned Senior Counsel appearing for the respondent submits that the present civil revision petition is sought to be withdrawn since certain facts have been omitted on the part of the petitioner, which plea is challenged by ld senior counsel for the respondent present on
