The Petitioner has approached this Court primarily for grant of compensation of Rs.5 lakhs as interim compensation to the Petitioner under the Delhi Government Assistance Scheme for Help of Riot Victims that has been framed by the Government to help the riot victims.

Mr. Sameer Vashisht, learned ASC for the GNCTD, has placed on record a communication dated 28.02.2024, issued by the Revenue Department: Relief Branch, GNCTD. The said communication reads as under:

as Ram Sugarat & Ors Vs GNCTD & Ors wherein it was directed to dispose of the representation of the petitioners. In this regard, the Hon'ble Minister (Revenue) in consultation with the Hon'ble Chief Minister, Govt. of NCT of Delhi has considered your representation and dispose of the same with the following decision:

1. Considering the pain and agony inflicted on the affected families due to the death of the minors in the riots of Feb-2020, additional ex-gratia of Rs. 5 Lakh may be granted to the family members of the deceased minors (including these 02 cases convered in the instant Court case) as a special case from the Chief Minister's Relief Fund of Govt. of NCT of Delhi. Proposal to be framed accordingly.

2. Secondly, as far as the matter regarding distinction in amount of ex-gratia to be granted to minors (Rs.5 Lakhs) and majors (Rs. 10 Lakhs) under the scheme "grant of ex-gratia relief in various eventualities" is concerned, the representation that there should not be any distinction between the majors and minors regarding compensation to families in case of deaths, the same will be kept in mind while reviewing the policy of "grant of ex-gratia relief in various eventualities" in future.

In view of the decision taken by the Hon'ble Minister (Revenue), the concerned District Magistrate is requested to process the case of minors who died during riots in Feb 2022 at the earliest for grant of additional ex-gratia of Rs. 5 lakh from Chief Minister Relief Fund.”

A perusal of the abovementioned communication indicates that the Petitioner is entitled to get additional compensation of Rs.5 lakhs from the Chief Minister Relief Fund. Let the said amount be disbursed within eight weeks from today. It is made clear that this decision shall be applicable

uniformly to all those persons who are identically situated to the Petitioner herein and they need not approach this Court individually by filing separate Writ Petitions.

For any other claim of the Petitioner, it is always open to the Petitioner to approach the Delhi Riots Claims Commission.

It is always open for the Petitioner to take other appropriate remedies as may be permissible under law for grant of additional compensation.

With these observations and directions, the Writ Petition is disposed of along with the pending applications, if any.

Liberty is also granted to the Petitioner to approach this Court in future if need so arises.
