Petitioners have prayed for quashing of FIR No. 1770/2015 under Section 313/34 IPC registered at police station Malviya Nagar, Delhi. Learned counsel for the petitioners submits that the matter stands settled between the parties on 15th January, 2016 before Mediation Centre, Tis Hazari Courts, Delhi. The petitioner no.1 and respondent no.2/Complainant have already obtained divorce by mutual consent on 12th January, 2017.
Learned Additional Public Prosecutor for the State has vehemently opposed for quashing of the aforesaid FIR on the ground that there are allegations under Section 313/34 IPC and Sections 22/23 of the Pre Natal Diagnostic Technique (Regulation and Prevention of Misuse) Act 1994.
After some arguments, learned counsel for the petitioners does not press the present petition.
The present petition is, therefore, dismissed as withdrawn.
