This so-called Public Interest Litigation has been preferred with the

following prayers:

“(a) issue a writ, order, direction in the nature of mandamus thereby directing the respondents to construct park, tree plantation for greenery of old persons and sports complex for youth players and children sports Complex behind the Fire Brigade Office, Opposite Side of D 9/1 Tekhand Adjacent Okhla Industrial Phase -1, New Delhi -110020 backside of JFJ Motors Bharat Petroleum Corporation Ltd. Near FCI Godown OkhIa Industrial phase 1 New Delhi -110020 where 2½ acres land is lying Baron/vacant for the General public and for the plantation for healthy atmosphere and environment for the old persons and for the youths who can bring medals in participating in sports at National and International levels like

Asian Games, Olympic and other sports events for glory of our nation.

(b) Further issue a writ, order or direction to the respondents thereby directing to demolish all the illegal structure made on the public land by encroachers/illegal occupants.

(c) Any other order or direction as this Hon'ble Court may deem fit and proper be also passed.”

Having heard the learned counsel appearing for both the sides and looking to the facts and circumstances of the case, it appears that this petitioner is in search of construction of a park, tree plantation as well as sports complex in the 2 ½ acres land lying vacant so that the youths can win medals for the country as stated in the prayer clause.

Taking note of the grievances ventilated in this writ petition, we hereby direct the respondents to treat this writ petition as a representation and consider it as early as possible and practicable after looking at the availability of funds and priority of works pending with them.

With the aforesaid observation, this writ petition is hereby disposed of.
