Exemption from forthwith eviction ordered subject to condition that petitioner vacates premises on or before 28.02.2020 and pays monthly user/occupation charges of Rs. 7,500/- with arrears cleared within four weeks.

Learned counsel for the petitioner submits he shall not assail the impugned order provided the petitioner is given time to vacate the premises. It is agreed the petitioner shall vacate the premises on or before 28^th February, 2020 on a condition the petitioner shall pay to the respondent an amount of Rs.7,500/- per month w.e.f. 01.09.2016 as user/occupation charges till vacation of the premises. The arrears be cleared by four weeks from today and future user/occupation charges be paid on or before 7^th of each calendar month. The water and electricity charges be paid as per actuals. The usual undertaking to this effect shall be filed by the petitioner within four weeks from today. Any default in the payment

of user/occupation charges shall entail eviction forthwith.

The petition along with pending applications stand disposed of in terms of above.
