Petitioner by this petition seeks a direction to the Respondents to refund the Earnest Money Deposit of Rs. 5,000/- submitted alongwith his bid.

Learned counsel for the respondent submits that the earnest money deposited had been furnished by way of demand draft and since demand draft got misplaced in the office of the NDMC, the same was never deposited and the NDMC never received money.
