Learned counsel for appellant candidly submits that in view of Supreme Court’s Constitution Bench’s recent decision in National Insurance Company Ltd. Vs. Pranay Sethi & ors., (2017) 16 SCC 680, he does not want to press this appeal.
In view of aforesaid, this appeal and the application are dismissed as not pressed. Statutory deposit, if any, be refunded to appellant-Insurer. The awarded compensation be released to respondents-Claimants forthwith in the manner and ratio as indicated in the impugned Award.
