This is an appeal under Section 10 of Delhi High Court Act and order XLIII Rule 1 read with Section 104 CPC read with Section 13 of Commercial Courts, Commercial Division and Commercial Appellate Division of High Courts Act, 2015 against the order dated 24.05.2017 vacating the interim injunction against the respondent passed by the learned Single Judge in CS (Comm.) 173/2016.
Learned counsel for the appellant submits that he has instructions not to press the present appeal and the CM APPLN. No. 46258/2017 as he has been informed that respondent has stopped using the name.
