Counsel for the appellants and respondents state that the witness namely Mr. Robert Andersen has been examined. Learned counsel for the appellants states that in view of the aforesaid position the present appeal may be disposed of as withdrawn and infructuous
leaving the question open, with right to the appellant to raise the issue of presence of Dr. Yuriy Reznic at an appropriate stage and as per law.
Learned counsel for the respondents states that the reasons given in the impugned order are correct. In case any objection and plea is raised by the appellant, he will meet the argument and raise all contentions.
In view of the above and recording the aforesaid statement, the appeal and the pending application are disposed of as withdrawn. We clarify that we have not expressed any opinion on merits.
