Costs as imposed vide order dated 26.07.2018 despite opportunity granted vide order dated 26.07.2018, 26.11.2018 and 05.12.2018 have not been paid.
Vide proceedings dated 26.07.2018, it had already been observed to the effect : -
“4. Today’s adjournment is granted subject to payment of costs of Rs.15,000/- by the appellant / decree-holder to the counsel for the respondents. If the cost is not paid, the appeal shall be liable to be dismissed for non-prosecution.”
and thus in terms of the order dated 26.07.2018, the EX. F.A. 35/2012 is thus dismissed for non-prosecution.
