Present suit has been filed for permanent injunction restraining infringement of trademark, passing off, dilution of trademark, damages, rendition of accounts, delivery up etc.
In pursuance to the last order, the defendant no.1 as well as Ms.Meena Lal, Chief Legal and Compliance Counsel along with Ms.Minakshi Aggarwal, Sr.Manager (Legal) are personally present.
After some discussion between the parties, learned counsel for the defendants states that the defendants shall not use, manufacture, sell, offer for sale, advertise, directly or indirectly deal in business of
steel or any other goods or services under the mark ‘TISCON’, ‘TISKON’ and ‘TATA’.
Learned counsel for the defendants states that the defendants shall withdraw the following marks:-
TEHRI TISKON 1710232 TRIKOOT TISCON 1814240 TEHRI TISCON 1649132
Learned counsel for the defendants further states that the defendants shall not apply for any mark similar or deceptively similar to ‘TISCON’ and shall not file opposition/rectification against the plaintiff’s mark.
In view of the aforesaid statements, learned counsel for the plaintiff states that the plaintiff does not wish to press the present suit for any other or further relief.
The statements/undertakings given by learned counsel for the defendants are accepted by this Court and the defendants are held bound by the same. Registry is directed to prepare a decree sheet accordingly.
In view of the aforesaid, present suit and all appending applications including contempt application stand disposed of.
