After some hearing, the learned counsel representing the second respondent in each of these three petitions, on instructions from Mr. Devender Singh, respondentno.2, who is present in person on his behalf and also on behalf of two others, submits that he fairly concedes, without prejudiceto his defences,that the order of the revisionalcourt may be set aside and that the trial may proceed in terms of the order dated 21.01.2013 of the Additional Chief Metropolitan Magistrate whereby charges were found made out and formally framed in its wake. The counsel for the petitioner submits that the petition may be disposed of in view of this concession.
The impugned order of the revisional court dated 01.03.2014is set aside. The order dated 21.01.2013 of the Additional Chief Metropolitan Magistratepassed on the file of criminal case arising out of the FIR No. 229/2005 stands revived and restored.
The formal charges have already been framed. The trial court shall take up the case for further proceedings in accordance with law on 4^*^ December, 2018 when the parties may appear before the said court.
The petitions are disposed of in above terms.
