By this petition, the petitioner seeks bail in case FIR No. 147/2017 under Section 392/394/365/34 IPC registered PS Alipur.

The above noted FIR was registered on an information received on 22^nd April, 2017 regarding looting of Truck No. HR-55W-1818 after abduction of driver and clearner near village Jindpur flyover was recorded vide DD No. 5A at PS Alipur. Statement of the complainant was recorded who stated that on the intervening night of 21^st -22^nd April, 2017 he along with his helper Ashok Yadav was going to Distt. Katani M.P in the above noted truck after loading 265 cartoons from the godown at village Sirsapur. When they reached near Jindpur flyover, one car overtook and stopped the truck. Three persons came down from the car and forcibly entered the cabin of the truck and pushed the driver behind the seat. One of the person started BAIL APPLN. 321/2018 page 1 of 3

driving truck towards Karnal bypass where the complainant and helper were shifted into the car. The truck followed them.

The complainant and his helper were thrown under the Wazirabad flyover after tying their hands and legs with pieces of clothes and the accused fled away with the loaded truck.

Six accused persons including the petitioner were arrested by the UP police at Bulandsehar on 1^st May, 2017 including the petitioner herein. In this regard FIR No. 1010/2017 was registered at PS Bulandsehar, UP. Six cartoons of the looted property was recovered on the arrest of six accused.

As per the case of the prosecution Lokesh, Yogesh and Shyamsunder are the accused who alighted from the car and had entered the truck, removed the complainant and the helper.

The role assigned to the petitioner Rinku is same as that to Deepak, Satish and Ravi i.e. they were part of the conspiracy and not present at the spot. Deepak, Satish and Ravi have already been granted bail by the learned Trial Court.

Considering the fact that the co-accused with similar role that is Deepak, Satish and Ravi have already been granted bail, this court deems it fit to grant bail to the petitioner.

It is therefore directed that the petitioner be released on bail on his furnishing a personal bond in the sum of ₹25,000/- with two surety bonds of the like amount subject to the satisfaction of the learned Trial Court out of which one surety would be a family member, further subject to the condition that in case of change of residential address the same will be intimated to BAIL APPLN. 321/2018 page 2 of 3
