Asubmissionhas been made beforeus by Mr. Alok Kuchhal,learned counsel for the petitionersthat, in view of the above, so far as the defaults attributedto the Directorsis concerned,'all deficiencieshave been addressed by them and, the reliefsoughtin the writpetitiondeservesto be granted. 11. It is further submittedby Mr. Alok Kuchhal, learned counsel for the petitioners'that the Companyhad throughoutcontinuedto run its business and, for this reason as well this writ petition ought to be favourably considered. 12. Contesting this claim, it is submitted by Ms.Maninder Acharya, learned ASG that mview of the above narrationof facts, it is an admitted position that the petitioners had defaulted and that the action of the respondentsin declaringthem as 'disqualified'under Section 164(2) of the CompaniesAct, 2013 cannotbe faulted. 13. Our attentionhas been drawn howeverto the Condonationof Delay Scheme, 2018 (hereinafterreferred to the "CODS Scheme, 2018") floated by the respondents, enabling such defaulters to seek removal of the disqualification.It is submittedthat in case the petitionerswish to avail the benefitofrestorationofthe directorship,they would be requiredto comport to the requirements of this scheme. 14. Ms.ManinderAcharya, learned ASG further submits on instructions of Mr.Sanjay Shorey, Joint Director (Legal) and Mr.RakeshTiwari, ROC (Delhi&Haryana),that ifthe petitionerswishedto avail ofthe benefitofthe CODS 2018, they may deposit the form e-Cods on behalf of deficient Company with the requisite fee payable under the scheme with the
