Issue a writ in the nature of or in the nature of certiorari or any other appropriate writ, order or direction declaring the entire process adopted by the Respondent No. 4 for selection of the team going to represent India in the Dragon boat Race event going to be held in the Asian Games, 2018 as arbitrary and illegal and to set aside the decision of the Respondent No.2, if any, finalizing the names of the athletes to represent
India in the said event based on such arbitrary and illegal procedure;
b. Issue a writ of or in the nature of mandamus directing the Respondent Nos. 1 and 2 not to finalize the names of athletes submitted by the Respondent No.4 and not to submit the same with the Organizing Committee of the Asian Games, 2018;
c. Issue a writ of or in the nature of mandamus directing the Respondents to conduct fresh trials for selection of the Indian team for the Dragon Boat Race to be held in the Asian Games, 2018 in the presence of a National Observer or an observer appointed by this Hon’ble Court.”
held in Dali, China in 5th Asian Dragon Boat Championship) approached this Court by way of a writ petition – W.P. (C) 7895/2018 titled “ Abhay Singh v. Union of India & Ors ”. Although, the last date for sending the names had expired, this Court directed the IOA to consider the case of the petitioner and take all steps to accredit the team to represent India in the event of Traditional Boat Racing. This direction was issued in the peculiar facts of the case and considering that in absence of accrediting any team, India would remain unrepresented. Further, given the performance of the Indian Team at Dali, it was almost certain that the said team would offer worthy competition at the ensuing games.
