Vide the present petition, the petitioner-institute has sought quashing of order dated 05.12.2016 whereby despite issuance of letter of intent, the petitioner’s application was rejected on the ground that the petitioner was unable to submit the approved list of faculty duly approved by the affiliating body within the prescribed time.

Learned counsel for the petitioner submits that immediately after the letter of intent had been issued by respondent No.2, the petitioner made attempts to get the faculty approved from the affiliating authority, but due to a State ban, the affiliating body was not inclined to approve the faculty sought to be appointed by the petitioner. He submits that now in the changed circumstances, when the respondent itself has taken a decision to process all applications of

those institutes which were made prior to the imposition of the State ban, the impugned order may be set aside and the petitioner may be granted another opportunity of 6 weeks to appoint its faculty and get the same approved from the affiliating body.

Issue notice. Ms.Monika Arora, Advocate accepts notice for the respondents and fairly does not oppose the petition.

In view of the aforesaid admitted position, the impugned order dated 05.12.2016 passed by respondent No.2 is set aside and the petitioner is granted opportunity to take requisite steps to appoint its faculty and after getting the same approved from the affiliating body approach the respondent No.2 for reconsideration of its application dated 27.06.2015 for running B.El.Ed. course. It is further directed that in case, the petitioner submits the approved list of the faculty within six weeks to respondent No.2, the said respondent will take a decision thereon within four weeks.

Needless to say that the present order has been passed without prejudice to the rights and contentions of both the parties.

The petition is disposed of in the above terms with no order as to costs.
