Learned counsel for the Judgment Debtor has handed over the copy of the order dated 29.04.2016 passed in CS (OS) No.2161/2012 titled ‘M/s M S Shoes East Ltd vs India Securities Ltd’ . Perusal of the order indicates that the application (IA No.17845/2015) filed by the defendant under Order IX Rule 19 CPC for setting aside the judgment and decree dated 24.04.2014 and 16.12.2014 was allowed and the judgment and decree dated 24.04.2014 and 16.12.2014 were set aside.
In the circumstances, it is apparent that present petition does not survive and is, accordingly, disposed of. All interim orders stand vacated and pending applications also stand disposed of.
