This is an application moved by the petitioner under Section 438 CrPC seeking anticipatory bail in case FIR No.1006/2014, under Sections 406/498-A/34 IPC, PS Tilak Nagar, Delhi.

Today the petitioner has handed over a sum of ₹2 lacs (by way of three pay orders, copy of which are placed on record) to the complainant, who is present in person alongwith her counsel.

Though earlier efforts for settlement through Mediation have failed, as informed by learned counsel for the parties, but today the complainant has accepted ₹2 lacs by way of three pay orders from the petitioner. Further, the parties still intend to explore the possibility of full and final settlement through mediation process.

Learned counsel for the parties agree that the above payment of ₹2 lacs to the complainant is subject to the adjustment towards settlement, if any, that takes place between the parties in future.

In the facts and circumstances of the case and also to explore the possibility of settlement, if any, between the parties, it is directed that in the event of arrest, the petitioner be released on bail for a period of six months on his furnishing personal bond in the sum of Rs.25,000/- with one surety of the like amount to the satisfaction of concerned IO/SHO. However, the petitioner is directed to join the investigation as and when required by the Investigating Officer.

In case, the settlement fails and petitioner apprehends his arrest, he is at liberty to file fresh application for seeking bail.

Application stands disposed of in above terms.

As prayed, copy of the order be given dasti to learned counsel for the parties.
