I have perused the FIR and find that the allegations levelled therein are general in nature as regards demand of dowry is concerned. The other allegations are that mother-in-law used to interfere in her works in the sense that she is finicky about cleanliness in the house and used to pull up the complainant on this count.
Learned Additional Public Prosecutor, who is assisted by the counsel for the complainant, admits that clothes of the complainant have already been returned pursuant to the orders of this Court passed in IPA 01/14. He further submits that grievance of the complainant is that gold jewellery and
other household articles have not been returned. List has been produced and a copy thereof was given to petitioner’s counsel.
Learned senior counsel for the petitioner submits that first three articles, as shown under the heading ‘Gold Given’, were given to the relatives of petitioner during the marriage ceremony. As regards fourth article under the same heading is concerned, it is submitted that only two gold chains were given. She submits that the above articles will be returned to complainant before the Investigating Officer. She further submits that Air Conditioner, LCD, Steam Iron, Mixer/Grinder, Double Bed with mattress and Dressing Table will also be returned on the same day. As regards other 13 articles, as shown in the list under the heading ‘List of Gold Articles’ are concerned, it is submitted that the same remained with the complainant all along and she had taken the same with her when she left the house. She further submits that receipts regarding purchase of said articles have even not been produced. Complainant has produced receipts worth 1.90 lacs only. Learned APP for the State admits this fact. Learned senior counsel for the petitioner, on instructions, submits that 2 lacs will be deposited with the Registrar General of this Court within two weeks.
Let `2 lacs be deposited with the Registrar General within two weeks.
Upon such deposit the amount be kept in the FDR initially for a period of one year with automatic renewals thereof.
Subject to petitioner fulfilling aforesaid offer, it is directed that in the event of arrest petitioner be released on anticipatory bail subject to his furnishing a personal bond in the sum of `15,000/- with one surety in the like amount to the satisfaction of the Arresting Officer/Investigating Officer/Station House Officer of the concerned police station.
Bail application is disposed of in the above terms.
