engaged on M''' April, 2011 at Citi Banquet. At the time of engagement,jewelry, split AC, microwaveoven, cash, clothes etc. were given. Marriagewas fixed for 30"^ October,2011. Gurudwara Hall was booked on 26"" May, 2011. Thereafter,SourabhGugnani and Sushma Gugnani startedpressurizingthe complainantto give a sum of ^5 lacs and Honda City Car as pre-condition of marriage. When complainant showed his inability to meet these demands, Sourabh Gugnani broke the engagement. On 2"^ April, 2012 complainantserveda legal notice on SourabhGugnani asking him to return ^"10 lacs, which was spent by the complainant on the occasion of engagementor to fix a new date of marriage. Neither the amount was returned nor the date of marriage was fixed. On account of this, deceased was constantly unhappy and used to remaintense. She committedsuicideon 25^'' April, 2012.

Learned counsel for the petitioner submits that the engagement was called of not for dowry but since Sourabh and the deceased were not temporarily comfortable. It was their mutual decision to call of the engagement. He ftirther submits that the parties have settled their disputes before the Delhi High Court

Mediation and ConciliationCentre on 13'*^ August, 2012 and in terms thereof Sourabh Gugnani has paid ^4 lacs to the complainant through two demand drafts, photocopies whereof have been placed on record. Complainant and petitioners have also exchanged gifts/articles, given to each other at the time of engagement.

Keeping in mind the totality of circumstances,it is ordered that in case of arrest, petitioners be released on bail, subject to their furnishing personal bonds in the sum of ^"10,000/- (Rupees Ten Thousand Only) with one surety each in the like amount to the satisfaction of Investigating Officer/Station House Officer concerned. Petitioners shall, however, cooperate in the investigation and appear before the Investigating Officer as and when called upon to do so.
