The counsel for the respondent no.l Uruversity appearing on advani· notice infonns that upon the petitioner making a representation to the Grievance Committee fonned in this regard, the case of the petitioner was examined in the meeting held on 5111 September, 2011 and merit was found in the plea aforesaid of the petitioner of his not being overage. It is stated that the Cotmnittee however found that the petitioner was even otherwise not eligible for the reason of not satisfYing another eligibility of having minimum of 75% attendance. It is stated that the attendance of the petitioner was 54%; photocopies of two sheets containing the said decision dated 5111 September, 2011 and the attendance record of the petitioner are handed over in the Court and which are taken on record.
