Since identical issues are involved in the above-mentioned writ petitions, they are being heard and decided by this common order.

By the present writ petitions, the petitioners seek quashment of the order dated 20.12.2023, whereby the petitioners have been deprived of the benefit of "Shram Samman Rashi" amounting to Rs.4,000/- and further seek a direction to the respondent authorities to release the said amount.

Learned counsel for the petitioners submits that the petitioners are working as daily wage/contingent employees against sanctioned Class-IV posts under respondent No.2 and are being paid wages at Collector rates. He submits that despite the circular dated 28.08.2023 issued by the Finance Department, Government of Chhattisgarh, providing for payment of "Shram Samman Rashi" of Rs.4,000/- to eligible daily wage employees, the petitioners have been illegally denied the said benefit on the ground that their wages are not drawn through the Treasury. It is contended that such a condition does not find place in the said circular and is wholly arbitrary. It is, therefore, prayed that the respondent authorities be directed to release the benefit of "Shram Samman Rashi" to the petitioners in accordance with the circular dated 28.08.2023.

Learned State counsel opposes the submissions advanced by learned counsel for the petitioners and submits that the petitioners are working in Pt. Jawahar Lal Nehru Memorial Medical College, Raipur, but they are not working against any sanctioned posts of the Medical College and their services are regulated by the autonomous body of the Medical College. He further submits that the employees working against sanctioned posts are already being extended the benefit of "Shram Samman Nidhi" and are receiving an amount of Rs.4,000/- in addition to their regular remuneration. Since the petitioners are not working against any sanctioned posts, they do not fall within the category of employees entitled for the said benefit under the circular dated 28.08.2023. Hence, the writ petitions deserve to be dismissed.

I have heard learned counsel for the parties and perused the material available on record.

Having considered the submissions advanced by learned counsel for the parties and perused the material available on record, it is apparent that the petitioners are claiming the benefit of "Shram Samman Rashi" in terms of the circular dated 28.08.2023 issued by the Finance Department, Government of Chhattisgarh. The said benefit is extended to the employees/workers who fall within the ambit of the said circular and fulfill the conditions prescribed therein.

In the present case, the petitioners have failed to establish that they are working against sanctioned posts of Pt. Jawahar Lal Nehru Memorial Medical College, Raipur. On the contrary, the stand taken by the respondents is that the petitioners are engaged under the autonomous body of the Medical College and are not holding sanctioned posts. The employees working against sanctioned posts are already being extended the benefit of "Shram Samman Rashi" . Therefore, merely because the petitioners are working as daily wage/contingent employees, they cannot claim the said benefit as a matter of right in absence of fulfillment of the conditions prescribed under the circular dated 28.08.2023.

In view of the aforesaid discussion, this Court does not find any illegality or infirmity in the action of the respondents in denying the benefit of "Shram Samman Rashi" to the petitioners.

Accordingly, both the writ petitions, being devoid of merit, are hereby dismissed .
