1) The petitioner has filed this petition seeking the following reliefs:

“10.1 That, this Hon'ble Court may graciously be pleased to issue a writ of mandamus/certiorari or of like nature to the respondents directing to extend the dependent employment to the petitioner within stipulated period with all consequential benefits whatsoever with further direction to make the payment of all the retiral dues to the petitioner.

10.2 That, a command/direction may kindly be issued to the respondents to consider and decide the representations of the petitioner pending before the respondents within stipulated period in an objective manner by speaking order.

10.3 Any other relief which is deemed fit and proper by this Hon'ble Court may also be awarded to the petitioner along with the cost of the petition.”

2) Learned counsel for the petitioner would submit that the petitioner is the adopted son of Kailobai, who was an employee working under the respondents. She died in harness on 10.2.2010 and thereafter, an application for dependent employment was submitted by the petitioner before the respondent authorities on 30.10.2019. He would submit that the claim of the petitioner has not been considered on account of the pendency of a civil dispute with regard to succession. He would submit that the said dispute

has already been settled by the District Court, Baikunthpur. He would contend that a direction may be issued to the respondent authorities to decide the pending representation of the petitioner expeditiously.

3) Learned counsel appearing for the respondents would oppose the submissions made by counsel for the petitioner. He would submit that if there is no legal impediment, a decision would be taken by the respondent authorities strictly in accordance with law.

4) I have heard learned counsel for the parties and perused the documents placed on record.

5) Having considered the fact that the dispute with regard to succession has already been finally decided by the learned District Judge, Baikunthpur, the petitioner would be at liberty to place the said document alongwith other relevant documents before the Competent Authority and the said authority is directed to take a decision on the application moved by the petitioner for grant of dependent employment preferably within a period of 90 days from the date of receipt of a copy of this order.

6) Accordingly, the present petition is disposed of.
