1. By way of this petition, the petitioners have sought the following relief(s):-

“10.1 The Hon'ble court may be pleased to call for the entire records pertaining to the case of petitioner for cancellation of promotion order.

10.2 This Hon'ble Court may kindly be please to quashed the order impugned dated 03.10.2022 (Annexure P-1) passed by the respondent no. 4 and may kindly also be direct to the respondent authorities to keep remain continue the services of the petitioners of his existing Promotion post i.e. Head Master in different Primary School, Blockfarasgaon, District- Kondagaon, Chhattisgarh.

10.3 That, this Hon'ble Court may kindly be pleased to grant any other relief, as it may deem fit.”

Learned counsel for the petitioners would submit that the petitioners were

promoted to the post of Headmasters vide order dated 28.09.2022, subsequently, said order was canceled vide order dated 03.10.2022. It is argued that without affording any opportunity of hearing order Annexure P/1 was passed, and therefore, interim protection was granted in favour of the petitioners vide order dated 08.12.2022.

On the other hand, learned counsel appearing for the State would submit that vide order Annexure R/1 dated 14.10.2022, the order dated 03.10.2022 has

been recalled and order of promotion of the petitioners has been restored. He would submit that the grievance of the petitioners has already been redressed.

Heard.

Taking into consideration the fact that the order of cancellation of promotion has already been recalled by the District Education Officer, District Kondagaon vide order dated 14.10.2022 and interim order is operating in favour of the petitioners, therefore, in my opinion, nothing survives for adjudication as the grievance of the petitioners has already been redressed.

Accordingly, this petition is hereby disposed of.
