The petitioner has filed this writ petition seeking following reliefs:-

“10.1 That, the Hon’ble Court may kindly be pleased to allow the petition and direct the respondent to release the salary of petitioner during her suspension period from 03.08.2016 to 20.01.2025, in the interest of justice. ”

Learned counsel for the petitioner submits that the petitioner while working on the post of Teacher (Panchayat) and posted at Government

Middle School, Bharritola, Block – Manpur, District – Rajnandgaon was put under suspension by the order of Chief Executive Officer, Janpad Panchayat, Rajnandgaon vide order dated 29.12.2018 (Annexure P/1). He contended that though the Enquiry Officer and the Presenting Officer was appointed, however, thereafter, no further consequential order was passed. Pursuant to the policy formulated by the State Government, the schools running under the Panchayats have been taken over by the State Government and merged with the School Education Department, State of Chhattisgarh and services of the petitioner were also absorbed by the School Education Department vide order dated 06.08.2019.

He contended that the petitioner’s suspension was revoked vide order dated 20.01.2025 (Annexure P/3), however, the difference of pay from the date of suspension till the date of revocation of the order of suspension is not paid to the petitioner. Petitioner has already submitted representation before the respondent authorities on 05.12.2025, however, till date no decision has been taken and therefore, direction be issued to the respondents to take decision on the representation submitted by the petitioner at the earliest.

On the other hand, learned counsel for the Respondents/State submits that in view of the limited prayer made by the counsel for petitioner, she is having no objection. If the representation is pending consideration, it will be considered in accordance with law. He further submits that, if this Courts directs, he will file reply to the writ petition also.

I have heard learned counsel for the parties and perused the documents placed on record.

On due consideration of the submission of counsel for the respective parties, facts and circumstances of the case, nature of grievance raised by the petitioner in particular that the petitioner was initially suspended by

the Chief Executive Officer, Janpad Panchayat, Rajnandgaon vide order dated 29.12.2018 (Annexure P/1) and the order of suspension has been revoked vide order dated 20.01.2025 (Annexure P/3) by the Joint Director, and the petitioner has already submitted representation before the authorities, which is pending consideration till date, I find it appropriate to dispose of this writ petition directing the Respondent No. 2 to take decision on the representation dated 05.12.2025 submitted by the petitioner in accordance with law, expeditiously, preferably within a period of 03 months from the date of receipt of order.

With the aforesaid observation and direction, this writ petition stands

disposed of .
