By way of this petition, the petitioners has prayed for following

reliefs:-

“10.1 That, this Hon'ble court may kindly be pleased to pass similar order passed in WPS No. 1711/2022 in matter of Rajeev Kumar Mishra & others, on 15.03.2022. 10.2 Any other relief, which this Hon'ble Court may deem fit.”

Brief facts of the case, is that, the petitioners were appointed as Shiksha Karmis under the Department of Panchayat and Rural Development and, pursuant to their appointments, they joined their duties at their respective places of posting, where they have been continuously working till date and are receiving their salaries from the concerned department. Subsequently, the post of Shiksha Karmi was renamed as Assistant Teacher (P), Teacher (P) and Lecturer (P), and the State Government, by taking a policy decision for absorption of Shiksha Karmis into the School Education Department, issued an order dated 30.06.2018 prescribing certain conditions; in compliance thereof, the

concerned District Education Officer issued absorption orders in favour of the petitioners, as a result of which their services now stand absorbed in the School Education Department and they are working under its administrative control. That the petitioners, who were appointed by order dated 29.06.2010 and are still working under the respondents, are similarly situated to other employees who approached this Hon’ble Court by filing writ petitions seeking appropriate directions for absorption in the School Education Department from a particular date, and upon hearing the parties, this Hon’ble Court was pleased to pass an order directing the authorities to decide their representations. Hence, this petition.

Learned counsel for the petitioners submits that petitioners may be allowed to make representation for their absorption in Department of School Education from a particular date before the respondents and the same may be directed to be decided expeditiously.

On the other hand, learned counsel for the State opposes the same.

I have heard learned counsel for the parties and perused the material available on record.

¶63

Be that as it may, the petitioners are at liberty to prefer such representation along with copy of this order before the respondents / competent authority within 30 days from the date of receipt of copy of this order and, in turn, if any such representation is preferred by the present petitioners for their absorption from a

particular date, the respondents / competent authority is directed to consider and decide the said representation in accordance with law and on its own merit by passing a reasoned and speaking order preferably within three months from the date of filing of said representation. However, it is made clear that this Court has neither expressed any opinion on the merits of the case nor issued any direction for absorption of the petitioners from a particular date.

With the aforesaid observation and direction the instant writ petition is disposed of.
