By the present writ petition, the petitioner has questioned the charge-sheet (Annexure P-2) issued against him in the

departmental enquiry on the ground that the charges are based on the same allegations for which he was facing criminal prosecution for the offences punishable under Sections 376, 294 and 506 of the IPC, arising out of the complaint lodged by the same complainant.

Learned counsel for the petitioner submits that during the pendency of the present writ petition, the departmental enquiry remained stayed and, in the meanwhile, the petitioner has been acquitted of the criminal charges. He further submits that in view of the subsequent development, the present writ petition may be disposed of with a direction to the respondent authorities to conclude the departmental enquiry within a stipulated period.

Learned State counsel submits that the departmental enquiry initiated pursuant to the charge-sheet (Annexure P-2) is still pending and the same shall be concluded, in accordance with law, within a period of 90 days.
