The petitioners have filled, this petition seeking the following reliefs:-

"10.1 that, this Hon'ble Court may kindly be pleased to

issue a writ in the nature of mandamus directing the respondents to re-fix the petitioner's seniority in the

gradation list from his initial date of joining and to place him at the appropriate position accordingly,

considering his continuous service.

10.2. That, this Hon’ble Court may kindly be pleased to

direct the respondents to grant all consequential

benefits, including consideration for promotion,

fixation of pay and seniority-based benefits, arising out of correction of the petitioner’s seniorty.

10.3. That, this Hon’ble Court may kindly be pleased to grant any other relief, as it may deems fit and appropriate.”

After arguing for some time, learned counsel for petitioner submits that the petitioner may be permitted to submit a fresh representation before the concerned respondent authorities raising his grievance, and the concerned respondent authorities may be directed to consider and decide the same in accordance with law.

Learned State counsel submits that in view of the limited prayer made by learned counsel for petitioner, he is having no objection.

On due consideration of the submissions of learned counsel for the parties and further considering the nature of grievance raised in this writ petition, without commenting anything on the merits of the case, this writ petition at this stage is disposed of with liberty to the petitioner to submit a fresh representation before the respondent authorities, who

shall consider and take a decision on the same, in accordance

with law.

Accordingly, this writ petition is disposed of with the aforesaid
