Learned counsel appearing for the petitioner submits that the present writ petition has been preferred against the inaction on the part of the respondent authorities in not considering the petitioner’s representation seeking modification of her place of posting from District Hospital, Korea to Ambikapur.

It is submitted that the petitioner was selected for M.S. (General Surgery) under the State NEET-PG counselling process and, upon successfully completing the course, was posted at District Hospital, Korea vide order dated 13.09.2025. Learned counsel further submits that the petitioner’s minor daughter has been diagnosed with Autism Spectrum Disorder and requires continuous medical treatment and parental care. The petitioner’s husband is working at Ambikapur, where the child is also undergoing treatment. It is further submitted that the petitioner is ready and willing to complete the entire period of two years of compulsory Government service and is not seeking any exemption from the said obligation. Learned counsel further submits that vacant posts are available at Ambikapur and that, in similar cases, the State Government has modified the place of posting of doctors while permitting them to fulfil their compulsoryservice obligations. It is, therefore, prayed that the petitioner’s representation may be directed to be considered by the competent authority and post her at District Hospital/Medical College/CHC, Ambikapur or nearby places to Ambikapur.

Learned State counsel has no objection to the prayer made by the petitioner and submits that, in case the petitioner submits a fresh representation along with all relevant documents including the medical prescriptions of her daughter before the competent authority, the same shall be considered and decided within a period of 30 days.

In view of the submissions made by learned counsel for the parties, the petitioner is directed to submit a fresh representation along with all relevant documents and medical prescriptions of her daughter before the Secretary, Department of Health and Family Welfare, within a period of 15 days from today. On receipt of such representation, the competent authority shall consider and decide the same, in accordance with law, within a period of 30 days thereafter.
