The present writ petition has been filed by the petitioner seeking a direction to the respondent authorities for disbursement of the benefits of the third time bound higher pay scale, which according to the petitioner had already been sanctioned vide order dated 30.09.2021, along with consequential fixation of pension and payment of the admissible dues.

Learned counsel for the petitioner submits that the petitioner retired from service in February, 2018 from the post of Head Master, Middle School, Bharatpur. It is further submitted that the petitioner became entitled to the benefit of the third time bound higher pay scale with effect from 01.01.2016, i.e., during his service tenure. Although the competent authority granted the said benefit vide order dated 30.09.2021 with effect from 01.01.2016, the consequential monetary benefits and revision of pension have not been extended to the petitioner despite repeated representations. Learned counsel for the petitioner by referring to Annexure P/4 would submit that he has filed the representation before the concerned authority i.e. the District Education Officer, MCB on 03/09/2025 and the present writ petition be disposed of with a direction to consider the same.

Per contra , learned State counsel submits that the representations relied upon by the petitioner do not bear any acknowledgment/receiving of the office of the competent authority. It is submitted that if the petitioner submits a fresh representation before the District Education Officer,

MCB the same shall be decided in accordance with law.

Considering the submissions advanced by learned counsel for the parties, and without expressing any opinion on the merits of the claim made by the petitioner, this writ petition is disposed of with a direction that the petitioner shall submit a fresh representation along with all relevant documents before the District Education Officer, MCB within a period of 15 days from the date of receipt of copy of this order and on receipt of such representation, the concerned District Education Officer shall consider and decide the same by passing a reasoned and speaking order, strictly in accordance with law, as expeditiously as possible, preferably within a period of 45 (forty-five) days thereafter.

It is made clear that this Court has not expressed any opinion on the merits of the petitioner's claim, and the competent authority shall decide the representation independently in accordance with law.

With the aforesaid observations and directions, the writ petition stands disposed of.
